Article 1 - Definitions
For the purposes of these Terms and Conditions, the following definitions shall apply:
- Business Customer: any natural person, sole proprietorship, partnership, legal entity or other organisation acting in the course of a trade, business, craft or profession.
- Consumer: any natural person acting for purposes wholly or mainly outside their trade, business, craft or profession who enters into a distance contract with Aemster.
- Day: a calendar day.
- Durable Medium: any instrument that enables a consumer or Aemster to store information addressed personally to them in a manner accessible for future reference and which allows the unchanged reproduction of the stored information.
- Distance Contract: a contract concluded between Aemster and the consumer under an organised system for distance sales or services, without the simultaneous physical presence of Aemster and the consumer, and where exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract.
- Extended Duration Transaction: a distance contract relating to a series of products and/or services, where the obligation to supply and/or purchase is spread over a period of time.
- General Terms and Conditions: these Terms and Conditions of Aemster.
- Grace Period: the period during which the consumer may exercise the statutory right of withdrawal.
- Model Withdrawal Form: the standard withdrawal form made available by Aemster, which a consumer may use when exercising the right of withdrawal.
- Means of Distance Communication: any means that can be used to conclude a contract without Aemster and the consumer being simultaneously present in the same place.
- Aemster (or Entrepreneur): Aemster, being the natural or legal person offering products and/or services to consumers at a distance.
- Right of Withdrawal: the consumer's statutory right to cancel a distance contract within the applicable withdrawal period without giving any reason.

Article 3 - Applicability
- These Terms and Conditions apply to every offer made by Aemster and to every agreement, order and distance contract concluded between Aemster and a Consumer or Business Customer.
- Before a distance contract is concluded, these Terms and Conditions shall be made available to the customer in a manner that allows them to be stored on a durable medium for future reference.
- Where a distance contract is concluded electronically, these Terms and Conditions shall be made available electronically before the contract is concluded in such a way that they can be easily downloaded, saved and reproduced by the customer.
- If specific product or service conditions apply in addition to these Terms and Conditions, the customer may rely on the provision that is most favourable to them in the event of any conflict between the applicable provisions, unless otherwise required by mandatory law.
- If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original purpose and intent of the provision.
- Matters not expressly covered by these Terms and Conditions shall be interpreted in accordance with the purpose of these Terms and Conditions, applicable Dutch law and, where applicable, mandatory consumer protection legislation.

Any ambiguity regarding the interpretation of these Terms and Conditions shall be interpreted in a manner consistent with their purpose, intent and applicable law.
Article 4 - The offer
- If an offer is subject to specific conditions or is valid for a limited period only, this shall be clearly stated in the offer.
- All offers made by Aemster are non-binding. Aemster reserves the right to modify, amend or withdraw any offer at any time prior to the conclusion of the agreement.
- Aemster shall make every reasonable effort to ensure that product descriptions, specifications, images and other information are accurate and complete. Product descriptions are provided in sufficient detail to allow customers to make an informed purchasing decision.
- Product images, illustrations, specifications and other information displayed on the website are intended for informational purposes only. Minor variations between displayed images and the actual product, including variations in colour, packaging, dimensions or appearance, do not constitute a defect and do not entitle the customer to compensation, replacement or termination of the agreement.
- Obvious errors, mistakes, misprints, typographical errors, pricing errors or other inaccuracies in offers, product descriptions, quotations, advertisements or website content shall not be binding on Aemster. Aemster reserves the right to correct such errors at any time.

Each offer shall clearly state, where applicable:
- the total price, including VAT and other applicable taxes;
- any delivery or shipping charges;
- the available payment methods;
- the delivery method and estimated delivery timeframe;
- whether the statutory right of withdrawal applies;
- the procedure for exercising the right of withdrawal;
- the duration of the offer or any promotional pricing period;
- the steps required to conclude the agreement;
- the languages in which the agreement may be concluded; and
- any other information required under applicable consumer protection legislation.
- Where Aemster is subject to a code of conduct, information regarding such code of conduct and how it may be consulted shall be made available where required by law.
Article 5 - Formation of the agreement
- Subject to the provisions of paragraph 4 of this Article, the agreement is concluded at the moment the customer accepts the offer and completes the ordering process, including fulfilment of any applicable payment requirements.
- Upon receipt of an order placed electronically, Aemster will send an order confirmation by email without undue delay. This confirmation serves as acknowledgment of receipt of the order but does not necessarily constitute acceptance of the order.
- Aemster shall take appropriate technical and organisational measures to secure electronic communications, transactions and payments. Where electronic payments are offered, Aemster shall use reasonable security measures and industry-standard safeguards.
- Aemster reserves the right, within the limits of applicable law, to verify whether a customer can fulfil their payment obligations and to assess any information relevant to the responsible acceptance of an order. If Aemster has reasonable grounds to refuse an order, Aemster may reject the order, cancel the order, or impose additional conditions, stating the reasons where legally required.
- Aemster shall provide the customer, either before or upon conclusion of the agreement and on a durable medium where required by law, with information regarding:

a. Aemster's contact details and customer service information;
b. the conditions and procedure for exercising the statutory right of withdrawal, or where applicable, a clear statement that the right of withdrawal does not apply;
c. information regarding warranties, statutory consumer rights and after-sales support;
d. the total price, including applicable taxes and charges;
e. the applicable payment, delivery and performance arrangements; and
f. where applicable, the conditions for terminating any agreement of indefinite duration or extended duration. - For subscription services, recurring deliveries or other extended duration transactions, the information referred to in paragraph 5 may be provided with the first delivery or made available electronically on a durable medium.

All agreements are subject to product availability. If a product becomes unavailable after an order has been placed, Aemster will inform the customer as soon as reasonably possible and refund any amounts paid for the unavailable product without undue delay.
Article 6 - Right of withdrawal
The statutory right of withdrawal applies exclusively to consumers.
Business customers are not entitled to the statutory right of withdrawal unless agreed otherwise in writing.
Consumers may withdraw within 14 days after receiving the goods.
Withdrawal may be exercised through the withdrawal function on the website, by email, or by another clear statement.
Aemster will confirm receipt of the withdrawal request and provide a return shipping label.
Article 7 - Costs in case of withdrawal
Aemster provides a return shipping label after registration of the withdrawal request.
The cost of the return label will be deducted from the refund amount as follows:
- Returns from European countries: €8,95
These costs represent the direct cost of returning the goods.
If Aemster has delivered an incorrect product, a defective product, or otherwise made an error in fulfilling the order, Aemster will provide a return shipping label at its own expense. In such cases, no return shipping costs will be deducted from the refund amount.
Article 8 - Exclusion of right of withdrawal
Consumers may inspect and evaluate products as they would in a physical store in order to establish their nature, characteristics and functioning.
Customers may evaluate an Aemster diffuser by unpacking it, examining it and turning it on.
Adding scent oil to the diffuser may result in diminished value if the product can no longer be sold as new. Aemster reserves the right to deduct a reasonable amount for such diminished value from the refund.
You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Sealed Fragrance Oils
For sealed fragrance oils supplied in sealed packaging, the right of withdrawal may no longer apply once the seal has been broken, where permitted by applicable consumer law.
Incorrect deliveries
If you receive a product that you did not order, please contact us immediately via hello@aemster.com and leave the product unopened and unused.
Aemster will arrange the return shipment and ensure that the correct product is delivered as soon as possible.
Bundles
If you have purchased a bundle consisting of multiple products, the complete bundle must be returned in order to qualify for a full refund.
Article 9 - Prices
- During the validity period stated in the offer, the prices of the products and/or services offered shall not be increased, except for changes resulting from changes in VAT rates or other mandatory taxes.
- Notwithstanding the previous paragraph, Aemster may offer products or services with variable prices where such prices are subject to fluctuations in financial markets beyond Aemster's control. Any such fluctuations and the fact that quoted prices are indicative shall be clearly stated in the offer.
- Price increases within three (3) months after the conclusion of the agreement shall only be permitted if they result directly from statutory regulations or legal provisions.

Price increases after three (3) months from the conclusion of the agreement shall only be permitted if:
a. they result from statutory regulations or legal provisions; or
b. the consumer is entitled to terminate the agreement with effect from the date on which the price increase takes effect. - All prices displayed on the website, in offers and in order confirmations include VAT unless expressly stated otherwise.
- Aemster reserves the right to correct obvious errors, mistakes, misprints, typographical errors, pricing errors or other inaccuracies appearing on the website, in offers, quotations or order confirmations. Such obvious errors shall not be binding on Aemster.
Article 10 - Conformity, warranty and product use
- Aemster warrants that the products and services supplied conform to the agreement, the specifications stated in the offer, and the reasonable requirements of reliability and usability, taking into account the applicable legal requirements and regulations in force at the time of conclusion of the agreement.
- Any commercial warranty provided by Aemster, a manufacturer or an importer is in addition to, and does not affect, the statutory rights and remedies available to consumers under applicable law.
- Customers are requested to report any defects, damage, shortages or incorrectly delivered products within five (5) working days after delivery or, where a defect could not reasonably have been discovered upon delivery, within five (5) working days after discovery.
Prompt reporting enables Aemster to investigate the matter efficiently and, where applicable, initiate a claim with the shipping carrier or supplier.
Failure to report within this period shall not affect any statutory rights available to consumers under applicable law.
- Where a product needs to be returned for inspection, repair, replacement or refund, it should, where reasonably possible, be returned complete with all accessories and in its original packaging.
- Products must be used in accordance with the instructions provided by Aemster. Aemster does not warrant that any product is suitable for a specific purpose unless such suitability has been expressly confirmed in writing.

The warranty does not apply where a defect or malfunction results from:
a. repair, modification or alteration carried out by the customer or a third party not authorised by Aemster;
b. misuse, negligence, improper installation, improper maintenance or use contrary to instructions provided by Aemster;
c. abnormal operating conditions, accidents, external damage or circumstances beyond Aemster's reasonable control;
d. the use of unsuitable, incompatible, contaminated, adulterated or non-recommended fragrance oils or other substances;
e. normal wear and tear.
- Aemster diffusers are designed for use with fragrance oils intended for cold-air diffusion. Damage, malfunction, clogging, leakage, excessive residue build-up, reduced performance or other defects resulting from the use of unsuitable, incompatible, contaminated, adulterated or non-recommended oils are not covered by warranty.
- Customers are responsible for the careful handling, installation, operation and maintenance of diffusers, fragrance oils and related products. Fragrance oils should be used and stored in accordance with the instructions provided by Aemster.
- To the extent permitted by law, Aemster shall not be liable for damage resulting from improper use, accidental spillage, leakage, incorrect installation, failure to follow instructions, or the use of unsuitable fragrance oils. Customers are advised to take appropriate precautions when handling fragrance oils and diffusers, including protecting surfaces that may be affected by accidental spills or leaks.
- Nothing in these Terms and Conditions shall exclude or limit any liability that cannot be excluded or limited under applicable law.
Article 11 - Delivery and performance
- Aemster shall exercise reasonable care in processing, handling and fulfilling orders and in assessing requests for the provision of services.
- Delivery shall take place at the address provided by the customer. The customer is responsible for providing a complete, accurate and deliverable address. Aemster shall not be liable for delays, failed deliveries, additional shipping costs or other consequences resulting from incorrect, incomplete or inaccurate address information supplied by the customer.
- Aemster will make every reasonable effort to dispatch and deliver accepted orders within the estimated delivery period stated on the website or during the checkout process. Unless otherwise agreed, delivery shall take place within thirty (30) days after conclusion of the agreement.
- Delivery times are estimates only and are not guaranteed unless expressly agreed otherwise in writing. However, if Aemster is unable to deliver within the agreed or statutory delivery period, the customer shall be informed as soon as reasonably possible.
- If delivery is delayed beyond the agreed or statutory delivery period, the consumer shall be entitled to grant Aemster an additional reasonable period for delivery. If Aemster fails to deliver within that additional period, the consumer may terminate the agreement and receive a full refund of any amounts paid for the undelivered products.
- In the event of termination in accordance with paragraph 5, Aemster shall refund all amounts paid by the consumer without undue delay and no later than fourteen (14) days after termination of the agreement.
- If an ordered product is unavailable or cannot be supplied, Aemster may offer a suitable replacement product. The customer shall be informed of this clearly and in a comprehensible manner before or at the time of delivery. The consumer retains all statutory rights, including the right of withdrawal where applicable. Any return shipping costs relating to such replacement products shall be borne by Aemster.
- The risk of loss of or damage to products shall remain with Aemster until the products have been delivered to the consumer or to a third party designated by the consumer, other than the carrier.
Where a failed delivery, delay, loss or additional costs result from incorrect, incomplete or inaccurate delivery information provided by the customer, the associated risks and costs shall be borne by the customer.
- Customers are requested to inspect delivered goods promptly upon receipt and to report any visible damage, shortages or delivery issues in accordance with Article 10 and Article 17 of these Terms and Conditions.
Article 12 - Recurring services and subscriptions
- Unless expressly stated otherwise, all purchases made through the Aemster website are one-time purchases and do not constitute a subscription, membership, recurring delivery arrangement or other ongoing service.
- If Aemster introduces subscriptions, recurring deliveries or ongoing services in the future, additional terms and conditions may apply and will be made available prior to the conclusion of the agreement.
- Nothing in this Article affects any statutory rights available to consumers under applicable law.
Article 13 - Payment
- Unless otherwise agreed in writing, payment must be made using one of the payment methods offered during the checkout process on the Aemster website.
- The customer is responsible for providing complete and accurate payment information. Any inaccuracies in payment details must be reported to Aemster without undue delay.
- Aemster reserves the right to refuse, suspend or cancel an order where there are reasonable grounds to suspect fraud, unauthorized use of a payment method, chargeback abuse, or any other unlawful activity.
- If a payment is not successfully completed, Aemster shall be entitled to suspend performance of the agreement and withhold shipment of the order until payment has been received in full.
- In the event of non-payment, Aemster shall be entitled, subject to applicable law, to recover any reasonable costs incurred in collecting the outstanding amount.
- Ownership of delivered products shall remain with Aemster until full payment has been received, to the extent permitted by applicable law.
Article 14 - Complaints procedure
- Aemster maintains a customer complaints procedure and will handle complaints in accordance with this procedure.
- Customers are encouraged to submit complaints as soon as reasonably possible after discovering the issue. Complaints should be described fully and clearly and sent to hello@aemster.com, together with any relevant information, photographs or supporting documentation.
- Aemster will acknowledge receipt of a complaint and aims to provide a substantive response within fourteen (14) days of receipt. If a complaint requires a longer investigation period, Aemster will inform the customer accordingly and provide an indication of when a detailed response can be expected.
- Aemster will make reasonable efforts to resolve complaints promptly and amicably.
- The submission of a complaint does not suspend the customer's payment obligations or any other obligations under the agreement, unless otherwise required by applicable law or agreed by Aemster in writing.
- If a complaint is found to be justified, Aemster will, at its discretion and where appropriate, repair, replace, refund or otherwise remedy the issue free of charge, in accordance with applicable law.
- Consumers residing within the European Union may also have access to alternative dispute resolution mechanisms or other consumer dispute services available under applicable law.
- Nothing in this Article limits or excludes any statutory rights available to consumers under applicable law.
Article 15 - Governing law and jurisdiction
- These Terms and Conditions and any agreements between Aemster and the customer shall be governed by and construed in accordance with the laws of the Netherlands.
- If the customer is a consumer residing in a country within the European Union, the consumer shall additionally enjoy the protection of any mandatory provisions of the law of the country in which the consumer resides. Nothing in these Terms and Conditions shall limit or exclude any rights that cannot be waived under applicable consumer protection laws.
- Any disputes arising out of or relating to these Terms and Conditions or any agreement between Aemster and the customer shall be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
- The United Nations Convention on Contracts for the International Sale of Goods (CISG), also known as the Vienna Sales Convention, shall not apply.
Article 16 - Additional provisions
- Any additional provisions or provisions deviating from these Terms and Conditions shall not be to the detriment of the consumer and shall be recorded in writing or in a manner that enables the consumer to store them on a durable medium for future reference.
- In the event of any conflict between these Terms and Conditions and any additional provisions, the provision that is most favourable to the consumer shall prevail, to the extent required by applicable law.
- Any rights or remedies granted to consumers under applicable law shall remain unaffected by these Terms and Conditions.
- The statutory right of withdrawal and all related conditions, procedures, exclusions, return shipping costs and refund arrangements are governed exclusively by the Aemster Returns & Refunds Policy, which forms an integral part of these Terms and Conditions.
Article 17 - Lost or undelivered shipments
Customers are requested to report any missing or delayed deliveries within five (5) working days after the expected delivery date by contacting hello@aemster.com and providing their order number.
Prompt reporting enables Aemster to initiate an investigation with the shipping carrier while shipment records and tracking information are still available.
Reports submitted after this period may significantly reduce the likelihood of a successful carrier investigation. However, failure to report within this period shall not affect any statutory rights available to consumers under applicable law.
Article 18 - Giveaways
Aemster Giveaway Terms & Conditions
- Participation is open to AEMSTER customers and newsletter subscribers aged 18 years or older, unless otherwise stated in the specific giveaway announcement.
- Only one entry per person, household and email address is permitted unless expressly stated otherwise. Multiple, automated, fraudulent or duplicate entries may be disqualified at AEMSTER's sole discretion.
- Where applicable, participants must provide a valid and verified email address and any other information requested as part of the giveaway entry process.
- The giveaway period, eligibility requirements, prize details and winner selection method will be specified in the relevant giveaway announcement.
- Winners will be notified using the contact details provided during entry. If a winner fails to respond within the period specified in the giveaway announcement, AEMSTER reserves the right to select an alternative winner.
- Prizes are non-transferable, non-exchangeable and may not be redeemed for cash, credit or alternative products unless expressly agreed by AEMSTER.
- AEMSTER reserves the right to substitute a prize with an alternative prize of equal or greater value if circumstances beyond its reasonable control make this necessary.
- AEMSTER reserves the right to verify participant eligibility and to disqualify any participant who breaches these Terms & Conditions, provides false information or attempts to manipulate the giveaway process.
- AEMSTER reserves the right to amend, suspend or cancel any giveaway where necessary due to circumstances beyond its reasonable control or where required to ensure the fair administration of the giveaway.
- Personal data submitted in connection with a giveaway will be processed in accordance with the AEMSTER Privacy Policy and applicable data protection laws.
- To the extent permitted by law, AEMSTER shall not be liable for technical failures, lost entries, delays, interruptions, or any indirect or consequential damages arising from participation in a giveaway.
- Giveaways are not sponsored, endorsed, administered by or associated with Instagram, Facebook, TikTok, Pinterest, YouTube, X (Twitter), LinkedIn or any other social media platform unless expressly stated otherwise.
- By participating in a giveaway, participants agree to be bound by these Giveaway Terms & Conditions and any specific conditions stated in the applicable giveaway announcement.
- These Giveaway Terms & Conditions shall be governed by the laws of the Netherlands.
Website disclaimer
The information, content, materials, products and services made available on or through any AEMSTER website, webshop, country-specific domain, subdomain, mobile website or related online platform (collectively referred to as the "Website") are provided for general information purposes only, unless expressly stated otherwise in writing.
AEMSTER makes reasonable efforts to ensure that the information published on the Website is accurate, complete and up to date. However, AEMSTER does not warrant or guarantee that all information, descriptions, specifications, images, availability information or other content on the Website is accurate, complete, reliable, current or error-free at all times.

Intellectual property rights
All content made available on or through any AEMSTER website, webshop, country-specific domain, subdomain, mobile website, application or related online platform (collectively referred to as the "Website"), including but not limited to text, graphics, logos, icons, images, photographs, videos, audio clips, product descriptions, digital downloads, software, website design, layouts and data compilations, is the property of AEMSTER or its licensors and is protected by applicable copyright, trademark, database and intellectual property laws of the Netherlands, the European Union and other applicable jurisdictions.
No part of the Website may be copied, reproduced, distributed, published, transmitted, displayed, modified, reverse engineered, extracted or otherwise used for commercial purposes without the prior written consent of AEMSTER, except where permitted by applicable law.
In addition, all trademarks, trade names, logos, brand names, service marks, page headers, button icons, scripts, product names, service names and trade dress displayed on or through the Website are the property of AEMSTER or its licensors.
AEMSTER trademarks, trade names and trade dress may not be used in connection with any product or service that is not provided by AEMSTER, in any manner likely to cause confusion among customers, or in any manner that may damage, dilute or disparage the reputation of AEMSTER.
All other trademarks, logos, product names and company names appearing on the Website remain the property of their respective owners. The appearance of such marks does not imply any affiliation, endorsement, sponsorship or partnership with AEMSTER unless expressly stated otherwise.
Unauthorized use of any intellectual property displayed on the Website may violate copyright laws, trademark laws and other applicable laws and may result in legal action.
Nothing in these Terms and Conditions grants any licence or right to use any intellectual property belonging to AEMSTER or its licensors except as expressly stated herein.
Copyright and intellectual property complaints
AEMSTER respects the intellectual property rights of others and expects users of the Website to do the same.
If you believe that any content available on or through the Website infringes your copyright, trademark or other intellectual property rights, please contact AEMSTER promptly and provide the following information:
- a description of the intellectual property right that you claim has been infringed;
- a description of the material that you believe is infringing and its location on the Website;
- your name, company name (if applicable), postal address, telephone number and email address;
- a statement that you have a good faith belief that the disputed use is not authorised by the intellectual property owner, its agent or the law; and
- a statement that the information provided in your complaint is accurate and complete.
